Terms of Service

These terms are the agreement between you and Say & Sell Ltd, a company registered in England and Wales (company number 17392474) at 52 Whirlow Grove, Sheffield, United Kingdom, S11 9NR, for the use of Say & Sell. By creating an account you accept them. They are written to be read, so if something is unclear, email hello@sayandsell.com and ask.

What the service is

Say & Sell is a tool for building landing pages, offers and email funnels, and for taking payments and bookings through accounts you connect. We provide the tool. What you sell through it, and what you promise your customers, is yours.

Your account

  • You need to be 18 or over and give accurate details.
  • Keep your login to yourself. Anything done from your account is treated as done by you.
  • One account is for one business. Do not share or resell access without a written agreement with us.

What you may not do

  • Break the law, or help anyone else break it.
  • Send email to people who did not ask to hear from you. Every connected inbox sends as you, so the damage from doing this lands on your own domain and your own reputation.
  • Publish content that is hateful, harassing, obscene, or infringes somebody else’s rights.
  • Make health, income or financial claims you cannot back up.
  • Attempt to break, overload or reverse engineer the service.

We may suspend an account that does these things, and we will tell you why.

Your content

You own everything you create: your copy, your images, your customer list. You give us only the permission we need to host it and show it to the people you publish it to. You confirm you have the right to use whatever you upload, including photographs of other people.

Payments and your customers

When you connect a payment account, your customers pay you, directly. We never hold your money. That also means the relationship with your customer is yours: refunds, chargebacks, complaints, consumer rights and tax are your responsibility, not ours. We record that a payment happened so the hub can mark somebody as a customer and hand over what they bought.

What you pay us

Fees, and any free period, are as stated when you sign up. We can change our prices with 30 days’ notice by email. Payment processors charge their own fees, which are between you and them.

Third-party accounts

The service connects to accounts you already own, such as Google, Stripe and Instagram. Those come with their own terms, and we do not control them. If one of them changes or withdraws access, features that depend on it may stop working. How we handle data from those accounts is set out in our Privacy Policy.

Availability

We work to keep the service running and we do not promise it will never go down. We may change or remove features. If we remove something you rely on, we will give you reasonable notice.

Liability

The service is provided as it is. To the extent the law allows, we are not liable for lost profits, lost sales, lost data or indirect losses, and our total liability in any 12-month period is limited to what you paid us in that period. Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Ending it

You can close your account at any time. We can end this agreement if you break these terms. When an account closes, published pages stop being served and your data is handled as described in the Privacy Policy. Export anything you want to keep before you close it.

Governing law

These terms are governed by the law of England and Wales, and its courts have jurisdiction.

Changes

We may update these terms. We will change the date at the top, and for anything significant we will email you before it takes effect.
